Obtaining Rights to Record & Publish Music at Your Synagogue

QUESTION: Our synagogue wants to make a recording of music we use on Shabbat; how do we go about doing this?

  1. MAKE A LIST OF WHAT MUSIC IS TO BE INCLUDED.
    Title
    Composer and Arranger (if applicable)
    Name of publisher (usually at the bottom of a piece, or sometimes in the front or back matter)
    Date of copyright © (same as above)
    Name of collection/compilation music is taken from (if from a larger work like Gates of Song or The Complete Shireinu). Please include page numbers.
    (please note: While TMP can provide occassional clarification regarding copyright ownership, we are not a research agency and cannot do extensive research work for you.)
     
  2. E-MAIL ENTIRE LIST OF MUSIC TO to jrodovsky@urj.org or fax 212.650.4119
    Include name and contact information of institution
    Number of copies of the recording to be made
    Your request will be answered within two weeks.
     
  3. TMP WILL ISSUE YOU A MECHANICAL LICENSE
    based on our review of your list.
    A Mechanical License is a contract made between an institution or individual and the copyright holder (or designated licensing agent for same) whereby the limited rights to make an audio (not video) reproduction of a piece of music are granted.
     
  4. HOW IS THIS FEE DETERMINED?
    Current statutory rate (the industry standard fee) is $0.0855 per song per recording.

    EXAMPLE SCENARIO
    Temple Beth-El requests a Mechanical License for:
    Shalom Rav by Ben Steinberg
    R’tzei by Stephen Richards
    Avinu Malkeynu by Max Janowski
    There will be 2000 copies made of the recording.

    (3 songs) x ($0.0855) x (2000 copies) = 3 x $0.0855 x 2000 = $513.00
